Why Guests Come to Falmouth
- Woods Hole and the island ferry. The Steamship Authority runs ferries between Woods Hole and Martha's Vineyard, so many guests stay in Falmouth before or after an island trip.
- The science village. Woods Hole is home to the Woods Hole Oceanographic Institution and the Marine Biological Laboratory, founded in 1888. Visiting researchers, students and their families are a steady source of longer stays.
- The Falmouth Road Race. The 7-mile race ran for the 54th time on Sunday, August 16, 2026. The race site lists August 15, 2027 for the next one, and race weekend is one of the busiest weekends of the year.
- Shining Sea Bikeway. The town's 10.7-mile bike path runs from Woods Hole to North Falmouth.
- Beaches on two waters. Old Silver, Surf Drive, Menauhant, Falmouth Heights, Chapoquoit and Megansett, among others.
- Summer baseball. The Falmouth Commodores play in the Cape Cod Baseball League.
The Falmouth Rental Year
Falmouth has a longer season than most of the Cape. July and August are the peak, with weekly family rentals and Road Race weekend in mid-August. June and September stay busy with ferry traffic and cyclists. Because Woods Hole's institutions work year-round, some owners also see interest in monthly stays in the off-season from visiting staff and students; stays over 31 days fall outside the room excise and outside the new bylaw. Our mid-term rentals guide covers that option, and our seasonal pricing guide covers the summer peak.
Short-Term Rental Rules in Falmouth
At the 2026 Annual Town Meeting, Article 17 was voted as amended on April 7, 2026, creating Chapter 173 of the Code of Falmouth, "Operation of Short-Term Rentals." It takes effect January 1, 2027 and will be run by the Board of Health and Health Department. As of October 2026 we found no published Attorney General approval, and the town's short-term rentals page still shows 2024 working-group material, so check with the Health Department at (508) 495-7485 before planning around it.
What the adopted text says:
- License required. Any dwelling unit, or part of one, rented for 31 consecutive days or less needs a town license, valid for two years. Units rented 14 days a year or less are exempt.
- Fee not set yet. The Board of Health will set the fee, with no waiver or proration. At town meeting the committee chair said the amount was not yet known.
- An Operator within 20 miles. Each rental needs a designated Operator who lives within 20 miles and can be reached at all times during rental periods. The owner can be the Operator.
- Application. Proof of ownership, trash and recycling plan, a parking plan with at least one space per bedroom, noise provisions, your DOR certificate, smoke and CO certificates, the latest Title 5 certificate where applicable, a habitability attestation and $1 million of general liability insurance.
- Occupancy. Two people per bedroom plus two, with no more than twice that number on the property at any time. Rentals are to individuals only, with no paid-admission events.
- Ownership limits. No more than three licenses per owner. Properties owned even in part by a corporation, nominee trust or REIT are not eligible, nor are timeshares, affordable units, or anything not on a permanent foundation.
- Enforcement. Health, Fire Rescue and Building may inspect; refusing access voids the license. Fines are $300 a day, with civil penalties of up to $5,000 a day.
There is no owner-occupancy requirement. The same meeting also accepted the state's Seasonal Community designation and amended Chapter 172, the rental property bylaw, so it no longer applies to short-term rentals.
State taxes. Falmouth has a 6% local room excise, the 2.75% Cape Cod and Islands Water Protection Fund excise and the 5.7% state excise. The DLS databank also lists a 3% community impact fee since July 1, 2022, on professionally managed units. See our room occupancy tax page and the Massachusetts short-term rental laws.
Running a Rental in Falmouth
- Beach stickers for renters. For 2026 the town sold renter stickers by the week ($85 for one week, up to $225 for four) and a seasonal non-resident sticker ($275). Renters need proof of stay from the owner or agent plus their vehicle registration, so have a stay confirmation ready to send. Daily parking at Old Silver was $30.
- Dogs. Dogs are banned from public beaches from May 1 to September 30.
- Trash. Curbside trash for homes and buildings under five units is collected by the town's hauler and paid through property taxes, with a limit of two 32-gallon barrels or one 64-gallon cart per pickup. Recycling has been mandatory for residents and guests since April 2023, so label bins clearly.
- Parking. From 2027, the one-space-per-bedroom rule means on-site parking. Check your driveway before you count bedrooms in a listing.
- Septic. Have your latest Title 5 certificate on hand; the 2027 application asks for it.
How New England Host Co Works in Falmouth
New England Host Co covers Massachusetts statewide, and every home we manage has to be within 45 minutes of its crew's base, so for a Falmouth address we confirm the location first. If it fits, we create and optimize the listing, review pricing daily with PriceLabs around demand such as Road Race weekend, handle guest messaging, and send local crews for housekeeping and an inspection after every stay. License fees stay with the owner. See full-service management or send the address through our contact page.
